Our Litigation Department attorneys represent clients regionally and
nationally in a wide array of matters in federal and state trial and
appellate courts, and before regulatory and administrative agencies. Our
clients are wholly diverse and include small and large corporations,
not-for-profit organizations, trade associations, manufacturers,
railroad companies, governmental entities, franchisors, publicly and
privately-held businesses, educational systems, and individuals. Our
litigation attorneys have successfully tried matters involving contract
disputes, business issues, banking and lender liability, insurance
defense, shareholder disputes, construction matters, discrimination
claims and employment issues, product liability, noncompete agreements,
governmental immunity, personal injury, trademark and copyright
infringement, toxic torts, labor disputes, liability and insurance
coverage, and a broad range of general commercial litigation. In
addition to trial work, our attorneys call upon the talents and
experience of our other attorneys in representing and counseling our
business, commercial, environmental, fiduciary and governmental clients.

Survelliance
Our litigation team approaches the commercial litigation arena with a business prospective and often provides practical solutions to complex business issues. We frequently negotiate and draft settlement/ workout agreements before or during the course of litigation which may include payment plans, personal guarantees, new collateral, monthly reporting of financial information from the client's customer, or other terms to meet the client's needs. If requested, our litigation team is ready and prepared to take the case from early the stages of discovery through the completion of a trial. We strive to keep the client informed during all stages of the litigation process.
After obtaining a state or federal court money judgment, we can assist with negotiating and drafting a Forbearance Agreement which may include a forbearance arrangement allowing the debtor to make full payment under a specific payment plan, with monthly financial reporting and other financial disclosures to protect the client's interest. Alternatively, we an assist with the collection of a money judgment. We have experience in locating concealed assets and utilizing, if requested, asset searches and forensic accountants. We can facilitate obtaining other resources for our clients, if requested, such as a title search, judgment search, real estate appraisal, and property inspections.
Litigation Support
San Diego Private Detective represents numerous regional, commercial and community banks and commercial lenders in connection with workouts, mortgage foreclosures, commercial litigation and bankruptcy, as well as negotiating and drafting a variety of loan documentation. It provides consumer regulatory compliance advice to its local and national clients, as well as litigation of consumer compliance matters, including class actions on truth-in-lending and other disclosure and documentation matters. The Banking Group has evolved with the changes in the banking and lending industry, including the various consolidations that have taken place, as well as the change and addition of services being provided to the customers of banks and other lenders.
Our Firm's substantial investment in computers and technology rivals that of any firm in the state. We have the ability to utilize that technology to efficiently deliver work product, including loan documentation, to our clients via e-mail, desk-top faxing, Internet download, and high-speed copier/printers.
Asset Verification
The Intellectual Property Group provides the Firm's clients with broad and comprehensive services in the areas of domain name, copyright, trademark and trade secret law. When necessary, the Intellectual Property Group also utilizes the services of attorneys in the Firm's Litigation Department and Business Department. The area of domain name law has recently become important. Congress is finalizing legislation to restrict the ability of cybersquatters to obtain valid trademarks of other companies. The Intellectual Property Group has advised its clients on the issue of cybersquatting in particular, and the evolving law of domain name in general. Agreements between the domain name registrant and the service company also have been reviewed.
The Intellectual Property Group advises clients on copyright laws to protect their ideas expressed in books, articles, journals, photographs and other media. The Group also assists the copyright owner in preparing the copyright application. Questions of "joint ownership," whether the matter was a "work for hire," or whether the application comes under the "fair use" doctrine are also explored.
